  This Participation Waiver and Release (the “Release”) is executed by the undersigned participant (or, if the participant is a minor, by the participant’s parent or legal guardian) (the “Participant”) in favor of Playa Vista Moms Group Inc., a California nonprofit organization (“Organization”). Participation includes, but is not limited to, activities, events, workshops, and programs organized or sponsored by the Organization (collectively, the “Activities”).

  1. Release of Liability.  To the fullest extent permitted by law, Participant voluntarily releases, waives, discharges, and holds harmless the Organization and its officers, directors, employees, agents, and volunteers from any and all claims, demands, or causes of action, including those for personal injury, illness, property damage, or wrongful death, arising out of or connected to Participant’s participation in the Activities, except to the extent arising from the gross negligence or willful misconduct of the Organization. Participant understands that any equipment, products, or services used during the Activities may be provided by third-party vendors and are not owned, operated, or maintained by the Organization. The Organization makes no warranties or representations regarding the safety, condition, or suitability of such vendor-owned equipment. Participant agrees that any claims or issues arising from the use or malfunction of vendor-provided equipment must be directed to the respective vendor, and Participant releases the Organization from any liability related to such equipment.

  2. Assumption of Risk.  Participant understands that participation in the Activities may involve inherent risks, including but not limited to, physical exertion, personal injury, exposure to outdoor elements, and/or the actions of other participants. Participant voluntarily assumes all such risks. Participant understands and agrees that Participant is solely responsible for the supervision, safety, and behavior of Participant’s child(ren) during participation in the Activities. The Organization does not assume responsibility for supervising minors.

  3. Medical Consent.  In the event of a medical emergency, Participant authorizes the Organization to call 911 or seek emergency assistance as deemed necessary. Participant understands that the Organization does not provide medical care and is not responsible for administering medical treatment. Participant agrees to be responsible for any costs associated with emergency services.

  4. Media Release.  Participant grants permission to the Organization to use photographs, video, and audio recordings that may contain Participant’s image, likeness, and/or voice taken during the Activities for promotional and educational purposes in any manner and in all media now known or hereinafter devised, in perpetuity throughout the universe, without compensation.

  5. Liability for Property:  Participant agrees that Organization is not liable to us or our guests, for any personal property that is damaged, lost, or stolen while on or at the Activities, including, but not limited to, a vehicle or its contents, or any property or otherwise.

  6. Governing Law.  This Release shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

  7. Arbitration.  Any dispute arising out of or relating to this Release or the Activities shall be resolved by binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. However, either party may bring an individual claim in small claims court for disputes or claims within the jurisdictional limits of that court. Judgment on the arbitration award may be entered in any court having jurisdiction.

  By registering on the next page I affirm that I have read and understood this Release. I voluntarily agree to participate (or allow my minor child to participate) in the Activities. I accept and assume all risks associated with participation. I agree to the terms of the Release of Liability and Medical Consent. I grant the Media Release as described above.
